These Terms and Conditions govern access to and use of the website eternaltouch.it (the "Site"), operated by Carbon Stealth VCC, EIK BG208725180, with registered office at Ul. Samuil 3, 2670 Bobov Dol, Bulgaria ("Eternal Touch", "we"). By accessing the Site, the user accepts these Terms in full.
1. Nature of the site
The Site is an informational showcase for Eternal Touch, an atelier specialising in handmade gypsum decorations, event favors and bespoke creations. The Site is not an online sales platform: orders are processed via direct contact and a subsequent customised quote.
2. Intellectual property
All contents of the Site — including, by way of example, texts, photographs, graphics, logos, trademarks, design and source code — are the property of Carbon Stealth VCC or its licensors, and are protected by national and international copyright, trademark and industrial property laws. Any unauthorised reproduction, distribution, modification or use of the contents, even partial, is prohibited without the prior written consent of the Controller.
3. Permitted use
The user undertakes to use the Site exclusively for lawful purposes and in compliance with these Terms. The following are expressly prohibited:
- Attempting to access restricted areas of the Site without authorisation;
- Using automated tools (bots, scrapers) to extract content, unless authorised in writing;
- Uploading or transmitting unlawful, harmful, defamatory, offensive content or content that infringes the rights of third parties;
- Using the Site for unfair competition or for unauthorised commercial purposes.
4. Contact form and enquiries
Sending enquiries via the contact form does not constitute a binding order or acceptance of a contractual offer. Carbon Stealth VCC responds to enquiries with a customised quote. Any sales contract is concluded only following explicit written acceptance by both parties and payment of the agreed deposit.
5. Handmade products — nature and variations
All pieces are handmade. They may therefore present slight variations in shape, colour, weight and finish compared to the images published on the Site. Such variations are distinctive features of handmade products and do not constitute a defect.
6. Limitation of liability
Carbon Stealth VCC undertakes to keep the Site updated and functional, but does not warrant that the Site will be error-free, uninterrupted or free of viruses or harmful components. To the extent permitted by applicable law, Eternal Touch disclaims all liability for direct, indirect, incidental or consequential damages arising from use or inability to use the Site, except in cases of wilful misconduct or gross negligence.
7. Links to third-party sites
The Site may contain links to third-party websites. Carbon Stealth VCC does not control and is not responsible for the content, policies or practices of such sites. Access to external sites is at the user's own risk.
8. Privacy and cookies
Personal data processing is governed by our Privacy Policy. Cookie use is described in the Cookie Policy.
9. Changes to the Terms
Carbon Stealth VCC reserves the right to modify these Terms at any time. Changes shall take effect from the date of publication on the Site. Continued use of the Site after publication constitutes acceptance of the changes.
10. Applicable law and jurisdiction
These Terms are governed by Bulgarian law, save for mandatory consumer-protection rules of the EU Member State of the user's residence. Any dispute arising from the use of the Site shall be subject to the exclusive jurisdiction of the Court of Kyustendil (Bulgaria), without prejudice to the consumer's rights to bring an action before the court of their place of residence pursuant to Regulation (EU) 1215/2012.
11. Online Dispute Resolution (ODR)
Consumers residing in the European Union may use the European Commission's ODR (Online Dispute Resolution) platform, accessible at ec.europa.eu/consumers/odr.
